Welcome to Parasail Pro. These Terms of Service ("Terms") govern your access to and use of the Parasail Pro mobile application and website (parasailpro.com), operated by Fathom1K, Inc., a Delaware corporation ("we," "us," or "our").
By creating an account, accessing, or using Parasail Pro, you agree to be bound by these Terms. If you do not agree, do not use the app.
01Use of our services
Parasail Pro is a subscription-based software platform designed for parasail operators and their staff. You may use the app only if:
- You are authorized by a company with an active Parasail Pro subscription
- You are a current employee, contractor, or approved representative of that company
Parasail Pro is strictly for use by employees of registered companies. If a user is found to be misrepresenting their employment status, the associated company will receive a written warning. If the issue is not resolved, the user's account will be terminated.
You also agree not to:
- Misuse or interfere with the app or website
- Attempt to access data or accounts you are not authorized to use
- Reverse-engineer or copy any part of the service without written permission
02Account registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. If you suspect unauthorized use, notify us immediately.
03Subscriptions and payments
Parasail Pro is offered on a subscription basis. By subscribing:
- You agree to the pricing and billing terms presented at the time of sign-up
- Subscriptions renew automatically unless canceled prior to the renewal date
- Additional users or boats may be billed separately according to your plan
You are responsible for all applicable fees, including taxes.
04Termination
You may cancel your subscription at any time. We reserve the right to suspend or terminate your access if you violate these Terms or misuse the service. Upon termination, your access to the app and stored data may be revoked or deleted.
05Intellectual property
All content, branding, code, and features of Parasail Pro are owned by Fathom1K, Inc. or its licensors. You may not copy, modify, or distribute any part of the app or website without prior written consent.
06Data and privacy
Your use of Parasail Pro is also governed by our Privacy Policy. By using the app, you consent to the collection and use of your data as described therein.
07Tool-only disclaimer
Parasail Pro is a digital tool intended to help parasail operators manage logs, inspections, and operational records. At no time does Parasail Pro or Fathom1K, Inc. make recommendations, judgments, or suggestions regarding the safety of parasailing activities.
All data displayed in the app, including weather, inspection records, vessel position, engine telemetry, and other operational inputs, is either user-submitted or pulled directly from trusted external sources or equipment. Parasail Pro does not alter, interpret, or validate this data. Final decisions regarding the safety or suitability of any parasailing operations are solely the responsibility of the user and their organization.
08Community conduct
Parasail Pro may include features such as an industry feed or shared discussion areas. All users are expected to maintain professionalism at all times.
- Slander, harassment, or unprofessional behavior will not be tolerated
- On the first offense, the user will receive a written warning
- Any subsequent offense will result in account termination
Fathom1K, Inc. reserves the right to moderate and remove any content that violates these Terms.
09Disclaimer of warranties
Parasail Pro is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or secure. Use of the app is at your own risk.
10Limitation of liability
To the fullest extent permitted by applicable law, Fathom1K, Inc., its officers, directors, employees, affiliates, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
- Loss of revenue, profits, business opportunities, or goodwill
- Personal injury or property damage
- Operational decisions made based on data or features within Parasail Pro
- Errors, omissions, or inaccuracies in data (including weather, logs, or telemetry)
- Failure of the app to operate as expected
- Unauthorized access to or use of your account or data
- Downtime, delays, or service interruptions
- Any disputes between your company and its employees or third parties
Parasail Pro is a digital tool for logging and operational organization. It does not replace required inspections, decision-making, or human judgment in determining parasailing readiness or safety.
Your sole and exclusive remedy for dissatisfaction with Parasail Pro is to stop using the service and cancel your subscription.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in full.
11Modifications to these Terms
We may update these Terms from time to time. The latest version will always be posted on our website with an updated effective date. Continued use of the service constitutes acceptance of the revised Terms.
12Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware.
